The Saifee Foundation of Europe (“we,” “our,” “us”) is authorised and regulated by the Financial Conduct Authority (FCA) as a consumer credit lender under the firm reference 972455

We provide Qardan Hasana (interest-free loan). Some loans are regulated under the Consumer Credit Act 1974, while others – such as business purpose loans are unregulated.

We act as a data controller when processing personal data. We comply with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, the Privacy and Electronic Communications Regulations (PECR), and all other applicable laws.

2. The Data We Collect

We may collect and process the following categories of personal data in connection with your Qardan Hasana application and services:

  • Financial Data – income, expenditure, credit history, bank account details, affordability information repayment history.
  • Transaction Data – Qardan Hasana loan applications, loan agreements, and repayment schedules and account activity.

  • Special Category Data – in limited circumstances we may process health related information where voluntarily disclosed to support affordability assessments or vulnerable considerations. 

3. How We Collect Your Data

We collect personal data:

  • Directly from you (application forms, phone calls, emails, website submissions).
  • From third parties where necessary (credit reference agencies, fraud prevention agencies, open banking providers, professional advisors.).
  • From publicly available sources (Companies House, electoral registers).

4. How We Use Your Data

We use your personal data in connection with your Qardan Hasana services for the following purposes:

  • To assess your Qardan Hasana application and affordability.
  • To carry out credit and identity checks and preventing fraud
  • To manage your Qardan Hasana account and repayments.
  • To comply with legal and regulatory obligations (FCA rules, anti-money laundering, fraud prevention).
  • To communicate with you regarding your Qardan Hasana account, repayments, and regulatory updates.
  • To improve our services and customer experience.
  • To conduct internal record keeping and audits
  • To send marketing communications (only where you have consented or where we have a legitimate interest).

We do not use your data for credit scoring with credit reference agencies.


5. Legal Bases for Processing

We rely on the following lawful bases under UK GDPR:

  • Contractual necessity – To assess your loan application, provide loan services, and manage your account.
  • Legal obligation – To comply with FCA rules, HMRC requirements, anti-money laundering laws, and other regulatory duties.
  • Legitimate interests – To prevent fraud, improving services and communicate with existing customers.
  • Consent – For marketing communications and for processing special category data where required.

We do not share your data with credit reference agencies.

We do not sell your personal data.

All third-party processors are required to comply with UK GDPR and FCA SYSC requirements.

If your data is transferred outside the UK, we will ensure appropriate safeguards, such as UK adequacy regulations or standard contractual clauses.


8. Data Retention

We retain personal data only as long as necessary to fulfil the purposes in this policy and to meet regulatory requirements. Typically, this is six years after the end of your relationship with us, unless longer retention is required by law.

This is in line with FCA record keeping rules (SYSC), HMRC requirements and Limitation Act 1980.

  • Request erasure (“right to be forgotten”), where applicable.
  • Restrict processing.

We may use automated systems to support affordability assessments or fraud checks when assessing Qardan Hasana applications. Where automated decision making is used, you have the right to request human intervention, you may express your point of view, and you may challenge the decision.

We do not use automated credit scoring from credit reference agencies.


11. Security

We take data security seriously and use appropriate technical and organisational measures to protect personal data:

  • SSL encryption on our website (look for “https” and a padlock in your browser).
  • Password-encrypted files for sensitive information.
  • Restricted access for authorised staff and volunteers, who are legally bound to maintain confidentiality.
  • Secure storage systems and audit logging.
  • Regular security reviews and FCA SYSC aligned controls.

Transmission of data over the internet is not completely secure, and any transmission is at your own risk.
