The Saifee Foundation of Europe

1. About Us
The Saifee Foundation of Europe (“we,” “our,” “us”) is a Regulated Consumer Credit Lender, authorised and regulated by the Financial Conduct Authority (FCA) under firm reference number 972455.

We provide Qardan Hasana (interest-free loans). Some of our loans fall within the scope of the Consumer Credit Act 1974 (CCA) and are regulated credit agreements. Other loans such as business purpose loans are unregulated.
Where a loan is regulated, we comply with the CCA, FCA Consumer Credit Sourcebook (CONC) and Consumer Duty requirements.
2. Our Agreement With You
These Terms and Conditions, together with your Qardan Hasana Agreement, set out the basis on which we provide regulated credit to you. By signing your Qardan Hasana Agreement, you agree to be bound by these terms.
Where your loan is regulated, you will also receive a Standard European Consumer Credit Information (SECCI) document before signing.
3. Eligibility
To apply for a Qardan Hasana with us, you must:
- Be at least 18 years old.
- Be a UK resident.
- Provide accurate and complete information in your application.
- Apply for a loan that is suitable and affordable for your circumstances.
We will assess affordability in line with FCA CONC5 and Consumer Duty requirements.
We may decline applications at our discretion, in line with our responsible lending obligations under FCA CONC and Consumer Duty.
4. Your Qardan Hasana
- The amount, repayment schedule, and total obligations will be set out in your Qardan Hasana Agreement.
- Your repayments must be made in full and on time, using the method agreed.
- Before entering into a regulatory agreement, we will provide you with a Standard European Consumer Credit Information (SECCI) document.
5. Credit Checks and Use of Information
- We will carry out credit and identity checks with credit reference and fraud prevention agencies as part of our regulated Qardan Hasana services.
- Details of how we process your personal data are explained in our Privacy Policy.
- Where applicable, missed, or late repayments may be reported to credit reference agencies and could affect your ability to obtain regulated credit in the future.
- We process personal data in accordance with our Privacy Policy and UK GDPR.
6. Repayments
- You must make repayments on the dates specified in your Qardan Hasana Agreement.
- If you miss a repayment, we will contact you to discuss your circumstances, we will work with you to find a fair and appropriate solution, and we may take proportionate steps to recover the outstanding balance.
- If repayments are not made, we may appoint debt collection agencies in line with FCA regulations. Any debt collection activity will comply with FCA CONC 7 and Consumer Duty requirements.
7. Your Right to Withdraw
If your loan is regulated, you have the right to withdraw from the agreement within 14 days of signing it (as required under the Consumer Credit Act 1974). If you exercise this right, you must repay the amount borrowed within 30 days.
8. Early Repayment
You may repay your Qardan Hasana early, in full or in part, at any time.
9. Our Responsibilities
As an FCA regulated lender, we will:
- Treat you fairly and in line with the FCA’s Consumer Duty principles which set out the core Consumer Duty outcomes and cross cutting rules which includes the fair treatment of vulnerable customers.)
- Provide information that helps you make informed decisions.
- Provide clear and transparent information about your Qardan Hasana and your rights.
- Support customers experiencing vulnerability or financial difficulty.
- Handle complaints promptly and fairly in line with our Complaints Policy.
- Comply with all relevant laws and regulations.
10. Your Responsibilities
You agree to:
- Provide accurate and up-to-date information in your application.
- Inform us if your circumstances change and may affect your ability to repay.
- Make repayments in full and on time.
- Use the loan for the purpose stated in your agreement.
11. Default and Termination
For regulated loans we may terminate your Qardan Hasana Agreement and demand full repayment only after issuing a Default Notice under section 87 of the Consumer Credit Act 1974.
For unregulated loans, termination will follow the process set out in your loan agreement.
We may terminate your agreement if
- You fail to make repayments as required.
- You provide false or misleading information.
- You become insolvent or bankrupt.
Any enforcement action will be carried out in accordance with legal and regulatory requirements.
12. Complaints
If you are unhappy with our service, please follow our Complaints Policy. If we are unable to resolve your complaint, you may refer it to the Financial Ombudsman Service.
13. Governing Law
These Terms and Conditions and your Qardan Hasana Agreement are governed by the laws of England and Wales. Disputes will be subject to the jurisdiction of the Courts of England and Wales.
