The Saifee Foundation of Europe

1. About Us
The Saifee Foundation of Europe (“we”, “our”, “us”) is a Regulated Consumer Credit Lender, authorised and regulated by the Financial Conduct Authority (FCA) under firm reference number 972455.

We provide regulated Qardan Hasana (interest-free loan) services in accordance with the Consumer Credit Act 1974 and FCA rules
2. Our Agreement With You
These Terms and Conditions, together with your Qardan Hasana Agreement, set out the basis on which we provide regulated credit to you. By signing your Qardan Hasana Agreement, you agree to be bound by these terms.
3. Eligibility
To apply for a Qardan Hasana with us, you must:
- Be at least 18 years old.
- Be a UK resident.
- Provide accurate and complete information in your application.
We may decline applications at our discretion, in line with our responsible lending obligations and FCA requirements.
4. Your Qardan Hasana
- The amount, repayment schedule, and total obligations will be set out in your Qardan Hasana Agreement.
- Your repayments must be made in full and on time, using the method agreed.
5. Credit Checks and Use of Information
- We will carry out credit and identity checks with credit reference and fraud prevention agencies as part of our regulated Qardan Hasana services.
- Details of how we process your personal data are explained in our Privacy Policy.
- Missed or late repayments may be reported to credit reference agencies and could affect your ability to obtain regulated credit in the future.
6. Repayments
- You must make repayments on the dates specified in your Qardan Hasana Agreement.
- If you fail to make a payment on time, we may charge default fees as permitted by law and set out in your Qardan Hasana Agreement.
- If repayments are not made, we may appoint debt collection agencies in line with FCA regulations.
7. Your Right to Withdraw
You have the right to withdraw from your Qardan Hasana Agreement within 14 days of signing it (as required under the Consumer Credit Act 1974). If you exercise this right, you must repay the amount borrowed within 30 days.
8. Early Repayment
You may repay your Qardan Hasana early, in full or in part, at any time.
9. Our Responsibilities
As a Regulated Consumer Credit Lender, we will:
- Treat you fairly and in line with the FCA’s Consumer Duty and Treating Customers Fairly (TCF) principles.
- Provide clear and transparent information about your Qardan Hasana and your rights.
- Handle complaints in line with our Complaints Policy.
10. Your Responsibilities
You agree to:
- Provide accurate and up-to-date information in your application.
- Inform us if your circumstances change and may affect your ability to repay.
- Make repayments in full and on time.
11. Default and Termination
We may terminate your Qardan Hasana Agreement and demand full repayment if:
- You fail to make repayments as required.
- You provide false or misleading information.
- You become insolvent or bankrupt.
Any enforcement action will be carried out in accordance with legal and regulatory requirements.
12. Complaints
If you are unhappy with our service, please follow our Complaints Policy. If we are unable to resolve your complaint, you may refer it to the Financial Ombudsman Service.
13. Governing Law These Terms and Conditions and your Qardan Hasana Agreement are governed by the laws of England and Wales. Disputes will be subject to the jurisdiction of the UK courts.
